ACC REVIEWS

When ACC makes any decision that the recipient of that decision does not agree with, the recipient has the right to make an application for review, which means they have that decision reviewed by an independent reviewer. An application for review must be lodged within 90 days of the decision. The application must be made on the official form obtained from ACC or an advocate. Initially ACC will look at the decision again and consider whether they agree with it or not. Sometimes mediation is held at this stage. If ACC decide to alter the decision, the application for review is then withdrawn. However, if they stand by the decision, they will then forward it to an independent reviewer who arranges for a hearing to be carried out. At the hearing both parties have the opportunity to put their case and the reviewer makes a decision to either uphold ACC’s original decision, quash it, or instruct ACC to follow certain procedures and issue another decision with renewed review rights.

If the recipient does not agree with the decision of the reviewer they can take the matter to appeal. This application must be made to the ACC Tribunal Court within 28 days of receiving notification of the review decision.

ACC APPEALS

If the recipient does not agree with the decision of the reviewer after receiving a written decision following a review hearing, they can take the matter to appeal. This application must be made to the ACC Tribunal Court within 28 days of receiving notification of the review decision.

ACC MEDIATIONS

When ACC makes any decision that the recipient of that decision does not agree with, the recipient has the right to make an application for review. However prior to the review the mediation process can be helpful. ACC has a mediation facility available and the legislation does pay for an advocate for the mediation process. This is where HR & Dispute Solutions can help by providing that advocacy assistance.

ACC NEGOTIATIONS

Sometimes when you are contacted by ACC or you are trying to contact them the communication becomes difficult. HR & Dispute solutions can help with the communication between ACC and a claimant. They can either contact the claimant or ACC on behalf of the other party or can attend meetings as an advocate and an extra pair of ears to try to help with the communication and negotiation process.
